A.
OVERVIEW
Pursuant to the Post–Secondary Learning Act, the Board of Governors of Mount Royal University
(“Board”) has the authority to make policies governing the use of the land owned by the Board.
The owner or authorized representative of the owner can enforce the Trespass to Premises Act of
Alberta (“TPA”) and Petty Trespass Act of Alberta (“PTA”). Through this Policy, the Board is
giving direction to its authorized representatives regarding how the authority under the law shall
be exercised.
B.
PURPOSE
The purpose of this Policy is to outline the responsibilities of and procedures for Security Services
or other authorized Mount Royal University agents (together, “Security Services”) relating to the
application of the TPA and PTA on University Campus premises. Mount Royal University
(“University”) has legal obligations to ensure the safety and security of University Campus
premises and its users, and will take all reasonable steps to meet those obligations.

SCOPE
This Policy applies to all members of the University community and all members of the public who
visit the University Campus

POLICY STATEMENT
The provisions of the TPA and /or PTA may be utilized by Security Services to respond to:
1.
Conduct that is unlawful;
2.
The use, or threatened use, of force or violence;
3.
Conduct that does, or is reasonably expected to, cause damage to or defacement of
University buildings, structures, facilities or premises;
4.
Interference in or disruption of the operation of the University, including the interference
with or disruption of the normal pursuits of University staff, students and visitors;
5.
Failure to comply with the terms of a permission granted by the University to use
University premises;

6.
Any conduct contrary to University policies or specific University directions; and
7.
Inciting, aiding or encouraging others to engage in any of the conduct described above.
The University supports and permits freedom of expression and lawful assembly, subject to the
limits set out above and any prescribed by law. Expression or assemblies that are carried out
peacefully and lawfully, even if with respect to controversial matters, will not in themselves invite
the use of the TPA or PTA. Any proposed use of the TPA or PTA will be proportional and comply
with the procedures and responsibilities set out in the Procedures to this Policy.
